Please read these Terms of use ("Terms") and Policies ("Policies") carefully before using the www.openartimages.com and the www.openartimages.org websites (the "Service") operated by the Open Art Images collective ("us", "we", or "our").

Your use of the Service is conditioned on your acceptance of and compliance with these Terms and Policies. These Terms and Policies apply to all visitors, users and others who use the Service.

By accessing or using the Service you agree to be bound by these Terms and Policies. If you disagree with any part of these then you may not access the Service.

Privacy Policy

We believe that you shouldn’t have to provide personal information to participate in the free knowledge movement, so you may use the Service without providing any personal information.

Because we want to understand how the Service is used and how we can make it better for you, we collect some information when you use the Service; data collection and usage is explained in detail below, in the next paragraph at point 2. In any case, we adopt tracking technologies in which the users remains completely anonymous. In particular, we don't collect any complete IP address, but only the first 2byte, as 78.192.xxx.xxx .

What We Collect and Receive

In order for us to provide you the best possible experience on our websites, we need to collect and process certain information. Depending on your use of the Services, that may include:

1. Contact us via email — for example, when you ask for support, send us questions or comments, or report a problem, we will collect your name, email address, message, etc. We use this data solely in connection with answering the queries we receive.

2. Usage data — when you visit our site, we will store: the website from which you visited us from, the parts of our site you visit, the searches and actions you do, the date and duration of your visit, your anonymised IP address, information from the device (device type, operating system, screen resolution, language, country you are located in, and web browser type) you used during your visit, and more. We process this usage data in Matomo Analytics for statistical purposes, to improve our site and to recognize and stop any misuse. We will never share such information with third-party vendors and we will never use it, directly or indirectly, for purposes other than those expressed in these terms. As we explain below at the paragraph “Opt-out of website tracking”, at any moment you can opt out of being tracked.

3. Cookies — we use cookies (small data files transferred onto computers or devices by sites) for record-keeping purposes and to enhance functionality on our site. You may deactivate or restrict the transmission of cookies by changing the settings of your web browser. Cookies that are already stored may be deleted at any time.

4. When You Complete a Survey for FeedBacks — OAI occasionally asks for feedback and publishes surveys on the Websites or through a reputable third-party service provider. Your participation in these surveys is on a voluntary and anonymous basis, unless otherwise specifically specified. We use the survey responses to improve our understanding of you, our visitors, and to determine how best to serve your needs. Information collected in these surveys is never sold, rented, or shared with third parties for marketing purposes.

5. When You Make a Donation — OAI will ask you to provide personal information that is necessary to process and service your donation online, which may include your name, billing and shipping addresses, telephone number, email address, and credit card number. Your credit card information will be temporarily stored on a secure server and used only for processing your online transaction. We will retain the information you provided for our records and to facilitate customer service.

6. When You Subscribe to our Newsletter — OAI will ask you to provide personal information that is necessary to process and send you the newsletter, which include only your email address. We will retain the information you provided for our records and to send other newsletters in the future.

7. Displaying content from external platforms — OAI displays video from Vimeo platform, it uses Mailchimp to provide the newsletter service and it uses Google Fonts to provide the best experience to our users. These external platforms may track personal and usage data as specified in the privacy policy of these services. OAI has no control over them, and assumes no responsibility for the content, privacy policies, or practices of any third party web sites or services.

You may choose to prevent this website from aggregating and analyzing the actions you take here. Doing so will protect your privacy, but will also prevent us from learning from your actions and creating a better experience for you and other users.

Your Rights

You have the right to be informed of Personal Data processed by OAI, a right to rectification/correction, erasure and restriction of processing. You also have the right to ask us a structured, common and machine-readable format of Personal Data that you had provided to us. We can only identify you via your email address and we can only adhere to your request and provide information if we have your Personal Data through you having made contact with us directly via email. We cannot provide, rectify or delete any data that we store on behalf of our users or customers. To exercise any of the rights mentioned in this Privacy Policy and/or in the event of questions or comments related to the use of Personal Data you may contact OAI’s support team at contact@openartimages.com. In addition, you have the right to lodge a complaint with the data protection authority in your jurisdiction.

Retention of data

We will retain and use your information as necessary for the purposes set out in this Policy and to the extent necessary to comply with our legal obligations, resolve disputes, enforce our agreements and protect OAI’s legal rights. We also collect and maintain aggregated, anonymized or pseudonymized information which we may retain indefinitely to protect the safety and security of our Site, improve our Services or comply with legal obligations. We will never sell your personal data to anyone.

Content Policy

Our Service make available images, informations and text and allows you to download and share this material ("Content"), belonging to the Wikimedia Commons database. You are responsible for the Content that you share or reuse by the Service, and by the Wikimedia Commons database, and you must respect its licenses and terms of reuse according to the law of the State where you operate.

Copyright Policy

We respect intellectual property rights of others. It is our policy to respond to any claim that Content displayed on the Service infringes unknowingly the copyright or other intellectual property infringement ("Infringement") of any person. OAI presents Content belonging to Wikimedia Commons database and in accord to its terms of use.

If you are a copyright owner, or authorized on behalf of one, and you believe that the copyrighted work has been copied in a way that constitutes copyright infringement that is taking place through the Service, please submit your notice in following the Wikimedia procedure for copyright violation. We only provide a service of data visualisation, we neither are owners nor host any data.

The user agrees to indemnify, defend, and hold OAI and its respective supervisors, trustees, officers, agents, and employees harmless from all claims, causes, allegations, costs, expenses, fees (including reasonable attorneys' fees), judgments, liabilities, losses, and damages arising from or related to your use of or operation of the Websites or any of its Materials. As we only provide a service of data visualisation, we neither are owners nor host any data, but we reuse open datasets that are referenced with complete metadata about their copyright and sources. We put all possible efforts into place to provide contents freely shareable and adaptable contents and not to infringe consciously any copyright or other intellectual property of any person.

Limitation Of Liability
